The Delhi High Court has allowed Sonam Wangchuk –
the Ladakhi activist on a hunger strike as part of the Cockroach Janta Party’s protests over the NEET exam paper leak – to be moved immediately from the state-run Safdarjung Hospital to Medanta in Gurugram. “We can’t ignore his concerns… we are of the opinion he should be shifted to a hospital of his choice.”
A bench of Chief Justice DK Upadhyaya and Justice Tejas Karia said moving Wangchuk to Medanta would ensure his fundamental rights were not violated, and also said a team of competent doctors would be set up to monitor his health.
The court was responding to a petition by Wangchuk’s wife, Gitanjali Angmo, who had challenged a single judge bench’s Sunday order. She posted a message of thanks shortly thereafter. “My heartfelt thanks to the Delhi High Court for passing favorable order of discharge of Sonam Wangchuk to Medanta, the hospital of our choice!” she said on

Earlier the court asked Solicitor General Tushar Mehta, appearing for the Centre, why Wangchuk should not be moved to Medanta. Mehta said the center had no issue with the move, but said it could not happen sans government consent.
The hearing this morning started with the court being taken through medical reports on Wangchuk’s health, and the opinion of private doctors and those from two government hospitals – Safdarjung and the neighboring AIIMS. “There does not seem to be an imminent threat to his life…” Akhil Sibal, a senior advocate appearing for Angmo, said. “Doctors’ reports (only) show nothing intravenous is warranted, as of now. Even in government hospitals he has been given oral medicines only.”
Sibal also pointed out Wangchuk‘s health had been monitored even at the protest site. He said: “… his vitals are stable. There are some parameter changes, undoubtedly (but) monitoring is what is being proposed. Monitoring can continue…no difficulty.”
The court then heard from a government doctor, who argued: “…WBCs (white blood cells, which fight infections in the body) are low. That is not normal.” He indicated the heightened risk of an infection in Wangchuk’s weakened state.
Meanwhile, Wangchuk also wrote a letter that was read out by his lawyer.

“He has written a letter…” Sibal told the court, in which he expresses his agony and says there are police all around, his device is snatched away, and nobody is allowed (to see him). “People are subject to searches…even papers aren’t allowed.”
Earlier this week Wangchuk was forcefully removed from the CJP’s Jantar Mantar protest site and admitted to Safdarjung. The removal was carried out by police who said they were following court orders to ‘do what needs to be done to save his life’.
The Delhi High Court on Tuesday (July 21, 2026) allowed activist Sonam Wangchuk, currently on a hunger strike in solidarity with the Cockroach Janta Party (CJP) protest in Delhi, to be transferred to his hospital of choice, Medanta Hospital.
Solicitor General Tushar Mehta submitted that the Center had no objection to transferring Mr. Wangchuk to Medanta, describing it as a reputed hospital. However, he stressed that Mr. Wangchuk should continue to remain under medical supervision and should not be discharged except on the advise of Medanta’s doctors.
Police whisked away Mr. Wangchuk from the protest site on Saturday (July 18, 2026) and was admit to the Safdarjung Hospital in Delhi. Ms. Angmo moved the Delhi High Court for moving him out of Safdarjung Hospital, which a Single Judge Bench of the court had rejected.
The Delhi High Court on Tuesday proposed shifting activist Sonam Wangchuk from Safdarjung Hospital to Medanta Hospital, noting a wide consensus among government and private doctors that he requires continuous medical monitoring in view of his ongoing hunger strike. A division bench comprising Chief Justice D.K. Upadhyaya and Justice Tejas Karia were hearing an appeal filed by Wangchuk’s wife, Dr. Gitanjali Angmo, challenging a single judge’s refusal to permit his transfer to a private hospital.
Solicitor General Tushar Mehta, appearing for the Center and Delhi Police along with Additional Solicitor General Chetan Sharma, informed the Court that the government had no objection to Wangchuk being transferred to Medanta. “I had interactions with the government also. Medanta is a reputed hospital. The government has no objection if Wangchuk is shifted there, but he may not get discharged against medical advice,” submitted Mehta.
The Court indicated that Wangchuk would be transferred to Medanta and that all medical records and treatment details from Safdarjung Hospital would be shared with the private hospital. “We propose to get him shifted to Medanta. He will be treated there. All treatment details and reports prepared at Safdarjung will be supplied to Medanta. We will pass orders after lunch,” the Bench said.
The Court’s proposal came after Wangchuk’s counsel, Senior Advocate Akhil Sibal, relied on reports prepared by doctors who had been consulting him for years and presented that there was no immediate threat to his life. Sibal argued that Wangchuk’s condition did not warrant hospitalization or intensive monitoring and that he had been monitored even while he was at the protest site.
